Topic: Financial and Operations
Approval Authority: President

Description: Deals with the employment status of persons working under a research grant or contract at York University; Has associated procedure.

Policy

It is in the interest of the University and its faculty members that persons hired for a definite term or task under research grants and contracts be fully remunerated from funds provided under the grants and contracts and that faculty members holding grants or contracts for research have as much freedom as possible to conduct such research.

Thus, unless specifically agreed by the University, persons hired under research grants and contracts awarded to York University faculty members are and shall be the employees of the faculty member and not employees of the University.

The faculty member responsible for a grant will have the obligations, duties and responsibilities of an employer. However, at the request of the faculty member, the University will provide payroll services and benefits administration to assist the faculty member in carrying out these duties and obligations.

Transitional Arrangements

Any person who at the date hereof is working under a research grant or contract under a contract of employment with the University, shall remain employed by the University for the duration of the contract term.

Persons employed by the University for an indefinite term shall remain employed by the University until their employment is terminated.
